PRIVACY NOTICE (CUSTOMERS)

Personal data in this Personal Data Protection Notice means any information in our possession that relates directly or indirectly to an individual to the extent that the individual can be identified from that and from other information in our possession. The personal data that we collect may also include sensitive personal data which means any personal data consisting of information as your physical or mental health or condition, your political opinions, religious beliefs or other beliefs of a similar nature, the commission or alleged commission of any offence by yourself, biometric data or any other personal data as the Minister may determine.

The personal data that may be collected and processed by us in the course of your dealings with us includes:

1. (i)personal identification and contact information such as your full name, display name, email address, phone numbers, identification document or number (such as your I/C number), address, height, weight, gender, date of birth, nationality, race, marital status, occupation, biometric data, photos and video images;
2. (ii)information in audio or video format such as recordings made via video images;
3. (iii)information obtained from cookies and other technologies such as information from public databases or data aggregators that may include your demographic information, location, media consumption, previous purchases, shopping habits, loyalty program information or lifestyle preferences;
4. (iv)job application information such as personal data contained on your resume or job application, previous employment history and academic results; and
5. (v)any other personal data you provide to us or collected by us in the course of our business relationship with you.

Please note that, when you provide personal data of third parties (such as next of kin information), you warrant that you have obtained their consent for you to provide their personal data to us.

We may collect and receive your personal data in a variety of ways, for instance:

1. (i)directly from you, when you choose to give it to us such as when your use our Services, when you send us completed enquiry, application or registration forms, when you take part in any activities or events organized by us, when you communicate with us by email, chat, telephone or any other means, or when you access our websites; and
2. (ii)indirectly, when we obtain information from third parties such as your organization, other authorised organisation members, talent agencies, identity verification services, credit reporting agencies, regulatory and enforcement agencies, public databases or sources, management corporations, third party service providers and other third parties that are connected to you (e.g., other customers that are related to you), and from such other sources to which you have given your consent to disclose your personal data.

We will process your personal data in accordance with the PDPA, its applicable regulations, guidelines and/or orders, taking into account the latest amendments to the foregoing, this Privacy Notice and any privacy terms contained in your agreement(s) or terms with us.

We may process your personal data by collecting, recording, holding, storing, using and/or disclosing it from the following purposes:

1. (i)to create, assess, manage, maintain and process customer accounts or portfolios with us;
2. (ii)to publish and moderate jobs, receive and manage applications, and support talent discovery;
3. (iii)to create projects, portfolios and shortlists, and enable collaboration;
4. (iv)to recommend talent or opportunities, measure service performance and improve reliability
5. (v)to manage our relationship with customers and to communicate with the customers, whether as our new, existing former or prospective customers;
6. (vi)to provide or supply customers with products or services;
7. (vii)to manage subscriptions and issue statements and invoices to customers;
8. (viii)to provide customers with information, notices, updates or to contact customers when necessary;
9. (ix)to comply with any law, court order or other legal requirement;
10. (x)to respond to any inquiries, requests or questions raised by customers;
11. (xi)to improve our customer service;
12. (xii)for any other purposes that are incidental or ancillary to or in furtherance to the above purposes; and
13. (xiii)to process, manage and review job applications and manage the entire application and interview process for potential employees and applicants.

(Collectively referred to as “Purposes”).

We will not disclose any of your personal data to any third party without your consent, except to the following categories of persons (whether within or outside Malaysia):

1. (i)third party vendors, service providers, consultant, contractors, agents, auditors, legal advisors and/or representatives engaged by us that require such information as is reasonably necessary for the primary purpose for which it was collected;
2. (ii)governmental, legal and/or regulatory authorities in order to comply with legal or regulatory requirements;
3. (iii)our related companies for operational and administrative purposes;
4. (iv)such other classes of third parties whom you have given their consent for the disclosure within the application form or other such forms.

Additionally, your personal data may be transferred outside of Malaysia to the class of third parties listed above for the purposes as stated in this Privacy Notice. By agreeing to this Privacy Notice, you consent to the transfer of your personal data outside Malaysia.

We use third parties’ analytics and tracking tools to help us track, segment and analyze usage of our website, and to help us or those third parties serve more targeted advertising to you on our website and across the Internet. Those tools may use technology such as cookies, web beacons, pixel tags, log files, Flash cookies, or other technologies to collect and store non-personal information.

At our request, these third parties collect and share with us information which would allow us to track information related to the usage of our websites, measure and research the effectiveness of our advertisements, track page usage and paths followed during visits through our websites, help us target our Internet banner advertisements on our websites and on other sites, and track use of our Internet banner advertisements and other links from our marketing partners' sites to our websites. They may also combine information they collect from your usage of our website with information they collect from other sources.

Please note that do not have access to, or control over, these third parties’ use of cookies or other tracking technologies.

You have the following rights under the PDPA in respect of your personal data that is held by us:

1. (i)the right to request for access to and for a copy of your personal data;
2. (ii)the right to request to update or correct your personal data;
3. (iii)the right to request us to limit the processing and use of your personal data (for example, requesting us to stop sending you any marketing and promotional materials or contacting you for marketing purposes); and
4. (iv)the right to request that we transfer your personal data to another organisation, subject to technical feasibility and compatibility of format.

However, please note that your abovementioned rights under the PDPA are subject to our right to rely on any statutory exemptions and/or exceptions to collect, use and disclose your personal data.

To the extent that you have provided (or will provide) personal data about your directors, shareholders, employees, representatives, agents (if you are a corporate entity/an organisation) and/or other individuals, you confirm that you have explained (or will explain) to them that their personal data will be provided to, and processed by, us and you represent and warrant that you have obtained their consent to the processing (including disclosure and transfer) of their personal data in accordance with this Privacy Notice.
